Affiliate Program Agreement

By joining the Hostivus Affiliate Program, you agree to promote Hostivus honestly and in compliance with our Affiliate Program Agreement. Affiliates earn one-time commissions for qualified new customer referrals that successfully subscribe and remain active past the 30-day clearance period. Commissions are paid monthly via PayPal or Payoneer. Misrepresentation, spam, self-referrals, or fraudulent activity may result in immediate termination and forfeiture of unpaid commissions.

This Affiliate Program Agreement (“Agreement”) governs your participation in the Hostivus Affiliate Program. By applying to or participating in the Affiliate Program, you (“Affiliate,” “you,” or “your”) agree to be bound by this Agreement, as well as Hostivus’s Terms of Service, Privacy Policy, and any other referenced policies (collectively, the “Policies”).

If you do not agree to this Agreement, you may not participate in the Affiliate Program.

Program Overview

The Hostivus Affiliate Program allows approved affiliates to earn commissions by referring new customers to Hostivus using unique tracking links provided through the affiliate dashboard.

Affiliates are independent contractors and are not employees, agents, partners, or representatives of Hostivus.

Eligibility and Enrollment

To participate, you must:

  • Be at least 18 years old
  • Provide accurate and complete application information
  • Be approved by Hostivus at our sole discretion

We reserve the right to accept or reject any affiliate application for any reason, including but not limited to brand fit, promotional methods, or compliance concerns.

Once approved, you will be provided with unique affiliate tracking links.

  • You must use only the links provided through your affiliate dashboard
  • Tracking relies on cookies and attribution systems
  • Hostivus is not responsible for missed tracking due to browser settings, ad blockers, cookie deletion, or technical issues outside our control

Referral cookies remain active for the duration specified in your dashboard at the time of referral.

Commission Structure

Affiliates earn a one-time commission for each qualified referral that becomes a new paying Hostivus customer.

Current standard commissions are:

  • $50 for Starter and Business plans
  • $75 for Ecommerce and Custom plans

Commission rates may change at any time. Any changes will apply prospectively and will be reflected in the affiliate dashboard.

Qualified Referrals

A referral is considered qualified only if all of the following conditions are met:

  • The customer is new to Hostivus and not an existing or past customer
  • The customer signs up using your affiliate tracking link
  • The customer completes payment for a qualifying plan
  • The customer does not cancel or request a refund within the 30-day refund or cancellation period

Self-referrals are strictly prohibited.

Payments and Payouts

Commissions are paid monthly, typically around the 15th of each month.

  • Payments are made via PayPal or Payoneer
  • You are responsible for maintaining accurate payout information
  • A 30-day clearance period applies to all referrals before commissions become payable

Hostivus may withhold or reverse commissions for refunded, canceled, fraudulent, or invalid transactions.

You are solely responsible for any taxes, fees, or reporting obligations related to affiliate earnings.

Promotional Guidelines

You agree to promote Hostivus ethically and in good faith.

You may promote Hostivus through:

  • Websites, blogs, and content platforms
  • Email newsletters where recipients have opted in
  • Social media channels
  • Educational content, reviews, or comparisons

You may not:

  • Misrepresent Hostivus pricing, features, or guarantees
  • Claim affiliations or endorsements that do not exist
  • Use misleading, deceptive, or false advertising
  • Engage in spam, unsolicited messaging, or bulk cold outreach
  • Bid on “Hostivus” or related brand terms in paid search ads unless explicitly approved
  • Use coupon, deal, or cashback sites without written permission
  • Impersonate Hostivus or represent yourself as Hostivus staff

Violation of these rules may result in immediate termination and forfeiture of unpaid commissions.

Intellectual Property

Hostivus grants you a limited, non-exclusive, non-transferable license to use approved marketing materials solely for promoting the Affiliate Program.

  • You may not modify logos, trademarks, or brand assets without permission
  • All Hostivus intellectual property remains the exclusive property of Hostivus
  • This license terminates immediately upon termination from the program

Relationship of the Parties

You are an independent contractor. Nothing in this Agreement creates any partnership, joint venture, agency, or employment relationship.

You may not bind Hostivus to any agreement or obligation.

Term and Termination

This Agreement begins upon your acceptance into the Affiliate Program and continues until terminated.

Either party may terminate participation at any time, with or without cause.

Upon termination:

  • You must stop using all affiliate links and promotional materials
  • Pending commissions may be forfeited if earned through prohibited methods
  • Hostivus may withhold final payment in cases of fraud or policy violations

Fraud and Abuse

Hostivus reserves the right to investigate all affiliate activity.

Any attempt to manipulate tracking, generate fake leads, abuse promotions, or otherwise exploit the program will result in immediate termination and loss of all unpaid commissions.

Limitation of Liability

To the fullest extent permitted by law, Hostivus shall not be liable for indirect, incidental, consequential, or special damages arising from participation in the Affiliate Program.

Our total liability under this Agreement shall not exceed the total commissions paid to you in the three months preceding the claim.

Indemnification

You agree to indemnify and hold harmless Hostivus, its officers, employees, and partners from any claims, damages, losses, or expenses arising from:

  • Your promotional activities
  • Your violation of this Agreement
  • Your violation of any applicable law or third-party rights

Modifications to the Agreement

We may update this Agreement at any time. Material changes will be communicated via email or dashboard notice.

Continued participation after changes take effect constitutes acceptance of the updated Agreement.

Governing Law

This Agreement shall be governed by and interpreted in accordance with the laws of the jurisdiction in which Hostivus operates, without regard to conflict of law principles.
